Welcome to AA Garden Fusion, a Pan-Asian fusion restaurant located at 206 Flagler Avenue, New Smyrna Beach, FL 32169. By accessing our website, making reservations, placing orders, or visiting our restaurant, you agree to be bound by these Terms and Conditions.
These terms apply to all visitors, customers, and users who access or use our services, including dine-in, takeout, delivery, and online ordering. We reserve the right to update these terms at any time, and continued use of our services constitutes acceptance of any modifications.
We reserve the right to refuse service to anyone for any reason at any time, including but not limited to violations of these terms or disruptive behavior.
Reservation Policy
To ensure a seamless dining experience at AA Garden Fusion, please review our reservation policies.
Operating Hours
Sun: 3PM-10PM • Mon: 4PM-10PM
Tue: CLOSED
Wed-Fri: 4PM-10PM • Sat: 3PM-10PM
Holding Time
We hold tables for a maximum of 15 minutes past the reservation time. Please call us if you are running late.
Large Parties
For parties of 8 or more, please call us directly to arrange your reservation and discuss any special requirements.
Cancellations
Please cancel at least 2 hours before your reservation time. Repeated no-shows may result in reservation restrictions.
Online Ordering
AA Garden Fusion offers online ordering for both delivery and pickup through our website. By placing an order, you agree to the following terms:
- Order Accuracy: Please review your order carefully before submitting. We are not responsible for errors in orders placed online.
- Menu Availability: Menu items are subject to availability. We reserve the right to substitute ingredients or cancel items that are unavailable.
- Pricing: All prices are in USD and subject to change without notice. Prices displayed at the time of order are final.
- Order Confirmation: You will receive an email or SMS confirmation upon successful order placement.
Delivery Policy
We offer local delivery within select areas of Volusia County, Florida.
Delivery Areas
New Smyrna Beach, Edgewater, Port Orange, Daytona Beach Shores, Daytona Beach, Oak Hill
Delivery Fee
Base fee: $15.00
+ Mileage surcharge for areas outside NSB ($2-$6)
Delivery Terms
• Estimated delivery times are approximate and may vary based on traffic, weather, and order volume
• Customer must be available to receive the order at the delivery address
• We are not responsible for food quality issues caused by incorrect delivery addresses or delayed acceptance
• Contactless delivery is available upon request
Payment Terms
We offer multiple payment options for your convenience:
Dine-In & Pickup
Cash, Credit/Debit Cards (Visa, Mastercard, Amex, Discover), Apple Pay, Google Pay
Delivery Orders
COD (Cash on Delivery) or Credit Card via Stripe (secure online payment)
Secure Payments
All online card payments are processed securely through Stripe. We do not store your credit card information on our servers. Your payment data is encrypted and protected according to PCI DSS standards.
Refunds & Cancellations: Order cancellations must be requested within 5 minutes of placing the order. Once food preparation has begun, we cannot offer refunds. For quality issues, please contact us within 24 hours with photos of the issue.
Food Safety & Allergen Information

Our kitchen handles and prepares foods containing the following allergens: peanuts, tree nuts, shellfish, fish, soy, wheat/gluten, eggs, dairy, and sesame. While we take precautions to prevent cross-contamination, we cannot guarantee that any dish is completely allergen-free.
- Please inform your server or include a note in your online order about any food allergies or dietary restrictions.
- For severe allergies, we recommend dining with caution or consulting with our staff before ordering.
- Menu items may be modified upon request, but we cannot guarantee the absence of allergens.
- AA Garden Fusion uses organic ingredients whenever possible, sourced from trusted local suppliers.
Intellectual Property
The AA Garden Fusion name, logo, "Organic Luxury" branding, menu designs, website content, and all associated imagery are the exclusive property of AA Garden Fusion and are protected by copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, or create derivative works from any content on our website without our express written permission. Social media sharing with proper credit to AA Garden Fusion is permitted and encouraged.
User Conduct
We are committed to providing a welcoming and enjoyable dining environment for all guests. By visiting our restaurant or using our services, you agree to:
- Treat our staff and other guests with respect and courtesy.
- Refrain from disruptive, aggressive, or inappropriate behavior.
- Follow our dress code: Smart Casual is appreciated.
- Not engage in illegal activities or solicitation on our premises.
- Supervise children at all times to ensure a pleasant experience for all guests.
We reserve the right to refuse service or ask guests to leave if their behavior is deemed inappropriate or disruptive.

AA Garden Fusion provides its services and website content on an "as is" basis without warranties of any kind. We do not guarantee the accuracy, completeness, or timeliness of information on our website.
Limitation of Liability: To the fullest extent permitted by law, AA Garden Fusion shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or website.
Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Volusia County, Florida.
